Law 21.643

Corporate

Compliance scaled to the real size of the business: assessment, priorities and a work plan with a defined scope and fixed fees.
In just a few years, Chilean law has multiplied the offences for which a legal entity can be held criminally liable, created a data protection authority with sanctioning powers and required every employer to adopt harassment prevention protocols.
The answer is not more manuals. It is understanding where the real exposure lies and organising the business around it.
Since 1 September 2024, corporate criminal liability covers more than two hundred offences, and only an effectively implemented prevention model can exempt the company.
The new regime becomes fully effective on 1 December 2026, with a Personal Data Protection Agency and fines of up to 20,000 UTM.
Every employer must have a prevention protocol and an investigation procedure for workplace harassment, sexual harassment and violence at work.
Management decisions are exposed both in criminal proceedings and in the assessment of whether the prevention model was effective.
A strong defense begins long before any proceeding: in how decisions are made inside the company.
